The moderator of the ARPChurch, Alan Broyles (compliant tool of Pope Kyle Sims, His Fatness, blessed be his name forever, and Patrick Malphrus (the pope’s lapdog) has called for an emergency meeting of the Executive Board of General Synod (that is, the Privy Council of Yes-Men and the Kangaroo Court) for this Thursday, September 26, 2024, to take up a complaint by Dan Eller (attorney and elder in the Greenville ARP Church) against (now dissolved) Second Presbytery for actions taken in the last two meetings of Second Presbytery. As you know, the Great Privy Council is led, directed, and controlled by the hierophants of the ecclesiastical mysteries of the ARPChurch.

Below is a copy of Eller’s complaint.


AMENDED COMPLAINT

I, Daniel B. Eller, am an elder at Greenville ARP Church and was serving as a delegate to the called meetings of Second Presbytery on Tuesday, August 13, 2024. During the course of the second called meeting, I filed a Complaint with the clerk alleging that the actions taken by Second Presbytery during the second meeting were unconstitutional as the entire meeting did not follow the Form of Government. I am now amending the previously filed complaint to include the following allegations:

  1. “The General Synod is the highest court of the Associate Reformed Presbyterian Church, representing in one body all of its particular Its primary responsibility is the initiation, planning, organization, and administration of programs designed to enable it to carry on the mission of God in Christ's Church by word and deed in the General Synod, the congregation, the presbytery, and the whole world.” Manual of Authorities and Duties, Introduction, paragraph #1.
  2. “The General Synod is the highest court of the ARPC and represents all of its Presbyteries. It bears the title of the General Synod of the Associate Reformed Presbyterian Church and constitutes the bond of union, peace, and correspondence among all of its congregations and courts.” Form of Government 12.1.
  3. “In its denominational administrative functions the General Synod has the power to...(D) Require all lower courts, institutions, and special ministries to observe the Standards;...(I) Oversee the affairs of the entire denomination, directing such measures as are necessary for the promotion of the peace, purity, and prosperity of all congregations under its ” Form of Government 12.24 (D) & (I).
  4. Pursuant to the Form of Government (9.30) ministers take several vows, including the following pertinent vows:
    • Do you accept the government, discipline, and worship of the Associate Reformed Presbyterian Church as agreeable to and founded on the Word of God?
    • Do you promise to submit in the spirit of love to the authority of the Presbytery in subordination to the General Synod, and to promote the unity, peace, purity, and prosperity of the Church?
  5. Similarly, the Form of Government (8.17) states the vows that elders are to take, including the following pertinent vows:
    • Do you accept the government, discipline, and worship of the Associate Reformed Presbyterian Church?
    • Do you promise to submit in the spirit of love to the authority of the Session and to the higher courts of the Church?
    • Do you promise in all things to promote the unity, peace, purity, and prosperity of the Church?
  6. Regardless of whether one is a minister or an elder, both have vowed to accept the government of the Associate Reformed Presbyterian Church. Furthermore, Ministers of the word have vowed to “submit in the spirit of love to the authority of the Presbytery in subordination to the General Synod, and to promote the unity, peace, purity, and prosperity of the Church.” Elders likewise vow“ to submit in the spirit of love to the authority of the Session and to the higher courts of the Church and to promote the unity, peace, purity, and prosperity of the Church.”
  7. The highest court of the Associate Reformed Presbyterian Church, The General Synod, held its annual meeting in June of 2024.
  8. As a result of the 2024 meeting of The General Synod, eight (8) recommendations from the Special Committee to Investigate Second Presbytery’s Handling of Allegations Against Chuck Wilson were passed, along with two additional clarifying motions. The pertinent recommendations to this complaint were: That Second Presbytery be dissolved as of September 1, 2024;
    • That the churches of Second Presbytery in South Carolina be moved into the bounds of Catawba Presbytery ([Footnote placed here by Editor]: Upon information and belief, a motion was made and passed to amend this recommendation to clarify that the bounds of Catawba Presbytery be expanded to include all of the South Carolina churches presently in Second Presbytery as it would be physically impossible to “move” the churches into the bounds of Catawba. The undersigned believes and asserts that a similar motion was made, and passed, concerning recommendation number 3 so as to expand the bounds of the Tennessee/Alabama Presbytery so as to include the churches physically located in the State of Georgia.);
    • That the churches in Georgia be moved into the bounds of Tennessee-Alabama Presbytery;
    • That the General Synod encourage members of Second Presbytery to transfer their credentials to Catawba or Tennessee-Alabama presbyteries (depending upon their geographical location);
    • That the Moderator appoint a commission in order to oversee the transfer of assets and dissolution of Second Presbytery;
    • That the General Synod encourage Catawba and Tennessee-Alabama presbyteries to use assets received for the purpose of church strengthening, already existing church plants, and new church planting, giving special consideration to the geographical areas of the former Second Presbytery;

The two additional clarifying Motions were made and passed, which state:

    • That the Moderator establish a commission to oversee and distribute funds to fulfill and continue the existing financial obligations of Second Presbytery and that the same commission study the best use of the remaining funds for the furtherance of the gospel in our denomination; and
    • That the Moderator direct the commission to deal with funds of Second Presbytery and be allowed to deal with the dissolution of Second Presbytery and to handle any requests for churches in Second Presbytery to change from their new presbytery.
  1. General Synod acted within its authority and for the purpose of promoting the peace, unity, and prosperity of the congregations under its care located in Second Presbytery when it decided to dissolve Second Presbytery.
  2. Upon information and belief, the moderator called the first meeting and members of Second Presbytery, with knowledge of the actions of General Synod petitioned the moderator of Second Presbytery a second called meeting on August 13, 2024.
  3. “If any matters which require immediate attention arise between the stated meetings, meetings shall be held upon the call of the moderator… At least one week’s notice of called meetings shall be given to all member of the Presbytery specifying the time and place of the meeting and the particular business for which the meeting is No other business shall be transacted at called meetings except that specified in the notice.” Form of Government 10.12 (emphasis added).
  4. The notice of the first called meeting appeared, on its face, to include matters which did not require immediate The undersigned (Dan Eller) issued a Point of Order at the outset of the first meeting of Second Presbytery petitioning the moderator to rule all of the agenda items, with the exception of the agenda item pertaining to the hiring of outside legal counsel to assist with the dissolution of Second Presbytery. The moderator agreed and ruled those items out of order.
  5. The ruling of the moderator was challenged and overturned by the The first meeting went forward.
  6. At the conclusion of the first called meeting, a second called meeting was held. The notice circulated to the presbyters for this called meeting stated that the purpose of the meeting was to: “Provide for open response and any actions related to the dissolution of Second Presbytery for congregations and ministers.”
  7. Prior to calling the second meeting to order, the Moderator attempted to cancel the meeting and stated that the petition was out of order. Some members of the gallery of delegates became angry. There were threats made, including an attempt to remove the moderator and to declare Mark Wright as the new One delegate even shouted that the moderator and other officers were free to leave and that a meeting would still be held. After several minutes of commotion, the moderator succumbed and went forward with the second meeting.
  8. During the second meeting a free for all ensued. First, a Motion was made by Peter Waid to forgive the debt of a Baptist Church. Regardless of the underlying merits of such a petition, it does not appear to be an emergent matter nor was this request specified in the notice of the called meeting. Second, a motion was made and passed to allow for churches to avoid all of the procedural safeguards of the Form of Government and to simply provide a notice to the clerk of their desire to be “dismissed” from Second Presbytery prior to September 1, 2024. Again, this motion does not appear to be an emergent matter, was not specified in the notice of the meeting, and more importantly—it calls for a procedure outside of the current Form of Government.

For the foregoing reasons, the undersigned hereby pray that the General Synod will review the actions taken by Second Presbytery at the called meetings held on August 13, 2024 and OVERULE [sic] and VACATE all such actions taken by Second Presbytery that were unconstitutional and contrary to the Form of Government.

  1. This complaint by Dan Eller is not just rich, it is fantastically, gloriously, and hallelujah rich to the extreme. Is it possible for an attorney to be this ignorant? Has Eller (a longtime member of the Greenville ARP Church) forgotten the story of Richard Taylor (elder in the Greenville ARP Church) who ignored his vows as an elder in the ARPChurch and sued General Synod after the “Snow” Synod? Has he forgotten that Taylor refused to submit to the will of General Synod? Has he forgotten how the session of the Greenville ARP Church circled-the-wagons in order to protect Taylor? (And, did you know there was talk of the Greenville ARP Church leaving the ARPChurch at that time?) For Eller to trot-out the officers’ vows of the ARPChurch as important is arrogance and hypocrisy. The session of the Greenville ARP Church shredded those vows in 2010/11!
  2. Eller complains the last two meetings of Second Presbytery were Well, let’s see. (1) Notifications were sent out in good order. (2) Motions were made and passed in the regular manner. (3) No one was intimidated to vote in a certain manner. So, as in the case of the “Snow” Synod when Taylor objected to the majority vote of Synod, Eller objected to the majority vote of Second Presbytery and walked out of the meeting before the adjournment.
  3. Eller speaks of the ruling of the moderator being challenged and Ok! That’s not out of order. It’s the democratic system at work. It’s the will of the body!
  4. Having read the minutes of the meetings and interviewed a number of those present, it seems the only intimidator at the meetings was Eller. Was he pushing his weight around as a lawyer and hierophant? Many thought so!!
  5. As you know, Ben Glaser, equus asinus, may he bray forever, was present at those meetings of Second Presbytery. I wish I had called The conversation might have gone like this: “Ben, since you were present for the final festivities of Second Presbytery, and since you are a renowned expert in jackasses, how would you describe the behavior of Dan Eller?” I think his description would have looked something like the photo to the right. I’m told there were no loud words from his mouth; nevertheless, the acid on his tongue burned menacing, saying something like he was an attorney, and since there wasn’t another attorney in the room to challenge him, he was the authority, and the members of presbytery had better follow his advice, for he had the Privy Council of hierophants in his pocket! And, you know, I believe that would be correct! The Executive Board is circling-the-wagons to protect and promote his cause.
  1. I think the most amusing thing in Eller’s complaint is his mock concern that Peter Waid made a motion to forgive the outstanding mortgage of the Narrow Way Baptist Church, McCormick. Well, there was only $18,000 left on the mortgage. The Narrow Way Baptist Church is a very successful church plant. As I understand it, the church plant has grown from nothing to over 200 in attendance. The church has grown to the point that the property in front of the church had to be purchased. Well, I thought the ARPChurch was about helping church plants of other denominations. According to World Witness, ARP congregations are not planted overseas. Good ARPs are delighted to plant and grow Baptist congregations and congregations of other denominations elsewhere. How is it that Eller doesn’t understand such an elementary thing? He needs to get with the program!
  1. David Griffin and Andrew Di Iulio have signed on with Eller in his complaint. Griffin and Di Iulio are toadies of the Greenville Mafia. (1) Griffin had an unspectacular career. He failed as a missionary and was sent packing. He was so successful as to close a congregation in Mississippi. Having lived in the home of Jim Bell, his father-in-law, for a number of years, kind friends went to bat for him and got him the position he now holds at the Greenville ARP Church. His great accomplishments in the ministry are . . . Shoot a monkey, I can’t think of any. (2) Andrew Di Iulio is a newbie to the ARPChurch. When he arrived in Second Presbytery with a bag of on-line degrees, we were told he came out of the charismatic, The Cross and the Switchblade, ministry of David Wilkerson in New York City. As pastor of the Devenger Road ARP Church, the congregation has failed to thrive. Recently, he was given a sabbatical in order to deal with troubles in his marriage. Perhaps Griffin and Di Iulio should apply themselves to matters more profitable than fetching water for Dan Eller. Well, I suppose a little bit of recognition is better than none at all.
  1. What are the ecclesiocrats and hierophants on the Privy Council thinking? In the world of evangelical Presbyterianism which is best represented by NAPARC, don’t they realize they are the odd-man-out in how they are dealing with ministers and congregations desiring to leave the ARPChurch? Don’t they know they have become objects of amusement? The bosses of the ARPChurch say they despise the heavy-handed tactics of the PCUSA in how they deal with their congregations and ministers who desire to leave. Somehow they fail to see they are functioning like the ecclesiocrats of the PCUSA.
  2. How does one explain such derangement? Well, they hate Chuck Wilson, the Reprobate and Heretic, may his name be cursed by all ARPs, to the point, if they can’t get at him, they will go after those they think are his friends. Truthfully, Wilson has caricatured them to point they would sell their daughters into prostitution and their sons into slavery if they thought that would help them get Wilson! Well, get this boys: Chuck Wilson was not involved in the last two meetings of Second Presbytery, he was not involved in the formation of Veritas Presbytery, and he will never apply for membership in Veritas Presbytery so long as benightedness falls on the ARPChurch.
